Shadowy litigious group nabs first Douchebaggy Award of 2011

In a stunning tribute to irony, the Environmental Protection Information Center Executive Director Scott Greacen is crying foul over closed-door negotiations being held by lawmakers in Sacramento that are aimed at boosting the state’s sluggish economy and lowering skyrocketing unemployment rates.

The T-S reported that a Republican senator and his four colleagues are asking for a revamping of the California Environmental Quality Act in exchange for supporting Gov. Jerry Brown’s plans to put a five-year income tax, sales tax and vehicle licensing extensions before voters in a special election.

The goal of the CEQA revamp would be to ease the abuse of California’s environmental regulations by special interest groups by limiting challenges to environmental impact reports, requiring citizens filing litigation against projects to make a $50,000 deposit — or 1 percent of the project’s cost, whichever is smaller — to the court before filing legal action and make telecommunications companies exempt from many environmental reviews. The proposal would also greatly broaden the types of projects exempted from the environmental review process.

The implications are apocalyptic for the group that seemingly exists solely to sue the hell out damn near anything that moves to achieve its goals.

”My first impression is that this is a really, really radical proposal that would gut CEQA and take away local communities’ ability to be involved in important planning decisions,” Greacen said. “The substance of this is just sweeping.”

Because protecting the right to sue with reckless abandon is monumentally more important than making serious reforms to fix our disastrous economy and nearly $27 billion budget deficit.

And for that Mr. Greacen, you’ve earned the Douchebaggy Award. Congratulations friend!

    Wait they don’t want jobs; others paying their bills while jobs get sucked out of California is their full-time gig.

    It’s high time the unregulated orgs get investigated and oversights put in – right now they hide under the “grassroots” cloak and operate outside the system of checks and balances.

  3. About time. CEQA has needed fixing for a long time. It has been misused all of the time and has become a monster. It was intended to make sure there were informed decisions when it came to making decisions but the anti groups have abused it by using it to drive up costs of things by frivolous challenges that when the little guy doesn’t have hundreds of thousands of dollars for litigation, then they give up. And they give up ot because the challengers are correct, but only because they can’t afford to prove they are right.

    This is a big reason why the progs and Girard wabt to make building anything outside city limits subject to a conditional permit. CEQA would require a full EIR even for a little house. That could add a xouple hundred thousand to the house and years for the process and approval. Then any wahoo could challenge it and if the poor guy who wanted to build the house didn’t have a hundred thou to throw away on the frivolous challenge then the prog anti challengers win by default.

Finally addressing the wrong things in our current CEQA laws as developed haphazardly by courts cause nobody in the leg had the balls to do so isn’t “eliminating” enviro oversight. It is eliminating abuse. Get over it. You think CA is a model for what? Insanity and waste, yes. Smarts wjem it matters, no.

  12. Hummm, only took how long to make this about the Arkley’s? Talk about one-note. Lets examine the Telecommunications aspects of this. If I am not mistaken, and I may be, Marky got elected on many promises, one of which,he promised to broaden our bandwidth for access to life outside this little paradise. This has not occured. In addition to blocking the development of avaliable commerical property, are the above identified groups also using the CEQA to block telecommunications companies? Just musing of course.

    Vehicle reg in AZ: It varies depending on the vehicle. There is a $4.00 title fee; an $8.00 registration fee; plus an air quality research fee of $1.50; and a vehicle license tax (VLT) assessed in place of a personal property tax charged by other states.

    The VLT is based on an assessed value of 60% of the manufacturer’s base retail price reduced by 16.25% for each year since the vehicle was first registered in Arizona (15% before 8/1/98). Then, as of the Dec 1, 2000 reduction, the rate is calculated as $2.80 (new vehicles)/$2.89 (used vehicles) for each $100 of the assessed value. For example, for a new vehicle that costs $25,000, the first year assessed value would be $15,000 and the VLT would be $420.00. The second year the assessed value would be $12,562.50 and the VLT would be $363.06.
